Divorce Litigation
.... litigation in the United States were
actually quite different from the legal requirements. In response to
social pressures, trial judges and lawyers often permitted spouses to
terminate their marriages with out proving grounds if both parties wanted
the divorce. Such divorces were obtained by having the plaintiff in effect
lie about the grounds without objection from the defendant.
A divorce reform movement took place in the early 1970's in the
United Kingdom and the Untied States. The movement .....

International Law
.... law must be those that the states
impose upon themselves, as states must give consent to the commands that
they will follow. It is a direct expression of raison d'etat, the
"interests of the state", and aims to serve the state, as well as protect
the state by giving its rights and duties. This is done through treaties
and other consensual engagements which are legally binding.
The case-law of the ICJ is an important aspect of the UN's
contribution to the development of international law. It's .....

Capital Punishment: Justice To The Victims And Their Families
.... citing the 8th Amendment of the U.S. Constitution. Th
8th Amendment states "Excessive bail shall not be required, nor excessive
fines imposed, nor cruel and unusual punishments inflicted." This was
meant to limit the severity of punishment imposed on an offender by judge
or jury, but instead it creates a paradox with its usage of the words
'cruel' and 'punishment.' Webster's dictionary defines cruel as "causing,
or of a kind to cause pain, distress, etc." Using this definition, one has

The Death Penalty Is Needed
.... penalty laws do not have lower crime rates or murder rates than
states without such laws. And states that have abolished capital punishment,
or instituted it, show no significant changes in either crime or murder
rates.
Don't murderers deserve to die? Certainly, in general, the
punishment should fit the crime. But in civilized society, we reject the
"eye for an eye" principle of literally doing to criminals what they do to
their victims: The penalty for rape cannot be rape, or for arson, .....

Death To The Death Penalty
.... moments, when the culprit is discovered while he
steals, as I mentioned already. Some murderers have very serious
psychiatric problems or are mental patients. In none of these cases is it
possible that the fear to be sentenced to death could act as an effective
deterrent.
There is another heavy limit. One who plans a crime rationally can
choose to go on, although he knows the risk he's running, thinking that he
won't be discovered. Most of the criminologists assert that the best way to
discoura .....

Marijuana
.... advantages that are claimed for
marijuana are real, many more patients would benifit. Another good thing is
that the doctors could get on with investigating marijuanas medical uses
with out fear of controversy. The last reason is the Fedral government
would benifit two ways, First the fedral revenues would increase, because
marijuana ciggaretes would be taxed at the point of sale. The companies
that make the ciggaretes would also pay income taxes. Secondly there would
be a reduse in the amount spent o .....

Ross Rebagliati And The Marijuana Issue
.... marijuana has little or no effect on an athlete's performance, and it
would not give him an advantage over other athletes, a ruling based on the
use of marijuana isn't necessary. In addition to this, many doctors have
stated that marijuana gives the athlete a disadvantage over others because
it could make that athlete tired, or weak.
Rebagliati's urine test showed trace amounts of marijuana. Doctors
say that it is very possible that one could inhale this small amount,
strictly from being in .....

The Drinking Age: An 18-Year-Olds Right
.... on automobile accidents. These
studies generally concluded that traffic accidents significantly increased
among teenagers after the MLDA was lowered.(Toomey 1) It can, however,
easily be argued that since these studies came out right after the drinking
ages had been lowered, they would naturally show that there was an increase
in death among teenagers. Anytime you change something dramatically it
takes a while for things to settle into a routine. If all of a sudden,
for instance, you allow 18-year .....

Capital Punishment: Injustice Of Society
.... prove this belief; however,
"[a]ll the evidence taken together makes it hard to be confident that
capital punishment deters more than long prison terms do."(Cavanagh 4)
Going ever farther, Bryan Stevenson, the executive director of the
Montgomery based Equal Justice Initiative, has stated that "…people are
increasingly realizing that the more we resort to killing as a legitimate
response to our frustration and anger with violence, the more violent our
society becomes…We could execute all three thousand .....

The Banning Of Guns Is Ineffective
.... which persist today. Firearms in the new world were used initially
for hunting, and occasionally for self-defense. However, when the colonists
felt that the burden of British oppression was too much for them to bear,
they picked up their personal firearms and went to war. Standing against
the British armies, these rebels found themselves opposed by the greatest
military force in the world at that time. The 18th century witnessed the
height of the British Empire, but the rough band of colonial .....

Jerry Falwell Vs. Hustler Magazine
.... was considered an opinion
protected by the First Amendment. The court ruled that the issue was
whether or not that opinion was outrageous enough to be considered an
intentional infliction of emotional distress and awarded Falwell money.
This case then went to the U.S. Supreme Court where they decided that
because Falwell is a public figure for the purposes of the First Amendment
law, he couldn't sue for intentional infliction of emotional distress by “
outrageous” conduct and therefore the Court of Appeal .....

Hammurabi's Laws
.... six is if a man has stolen
goods, he shall be put to death, and if he gave any stolen goods to people,
they shall be put to death too. Today a robber would usually get a fine or
jail time, and same for the person who received the goods, but wouldn't
receive a death sentence in most cases. You can see how str ict they were
on robbery back then, and probably not many robberies occurred. There were
also laws that dealt with stealing ox, sheep, ass, pig, or ship that,
unlike the previous laws, wasn't punish .....

Serial Killing: Is It An Addiction?
.... definition of the bio-psycho-social model states that an
addiction is the repeated use of a substance or a compelling involvement in
behavior that directly or indirectly modifies the internal milieu (as
indicated by changes in neurochemical and neuronal activity) in such a way
as to produce immediate reinforcement, but whose long-term effects are
personally or medically harmful or highly disadvantageous to society
(Pomerleau, 1988).
This viewpoint manages to catch all addictions, including both

Drug Abuse
.... to society for many different reasons..
Drugs have very harmful effects on the user and the people with
whom the user interacts. The user is affected in many ways. The most
popular drug in America, alcohol, is generally thought of as socially
acceptable and relatively harmless. But it can have devastating effects.
Alcohol might seem very harmless but it can harm the user very easily.
Alcohol is easy to obtain and consume. It is taken as a beverage and,
since it is legal, it can be purchased a .....

Corruption In The NYPD
.... Mollen stated that, " what we did find
shocking was a total ineptitude of police fighting corruption, they are
superb in fighting crime-except among themselves." Corruption is the
product of individual police officer and police environment, and its
control must mainly should come from the department.
Any number of elements or combination of things can influence the
behavior of an organization. Within the police department ; the
organizational hierarchy , the police culture, and the intera .....
